Foreclosure defense

  • Depending on your circumstances, I can guide you through a number of foreclosure defenses, including the possibility of obtaining a modification of mortgage (interest rate reduction, extending the loan term, and principal forbearance).
  • I can also advise and assist in a short sale, in which you sell your home for less than what you owe on it. In a typical short sale, the bank agrees to accept the lesser amount as full payment of your mortgage, freeing you from further obligation.
  • I can also advise and assist in requesting that your lender accept a "deed in lieu of foreclosure", wherein you deed your property back to the lender without the necessity of a foreclosure action. There are certain pitfalls with this type of transaction and before agreeing to provide a "deed-in-lieu" to your lender, you need to be aware of the potential problems such as a lender's potential right to claim a deficiency.
  • I will also review the bank's paper trail on your house. If the mortgage company doesn't have proper documentation indicating that it holds your note/mortgage, foreclosure proceedings may be delayed or stopped entirely, forcing the mortgage company to start all over again.
